If your business uses consumer reviews and testimonials as part of your marketing strategy, it’s crucial to stay informed about the Federal Trade Commission’s (FTC) latest regulations. The Trade Regulation Rule on the Use of Consumer Reviews and Testimonials (16 CFR Part 465) rule will take effect on October 21, 2024, and aims to crack down on deceptive business practices involving consumer feedback. Here’s what you need to know to ensure compliance:
Key Prohibitions Under the New FTC Rule
- Selling or Purchasing Fake Reviews
- If your Business is using fake or false reviews, including those generated by AI You must remove them. Authenticity is key.
- Creating Company-Controlled Review Websites
- Companies cannot create review sites that falsely claim to be independent or unbiased. Transparency is essential.
- Review Suppression
- Suppressing or hiding unfavorable reviews is a no-go. Businesses must allow an honest and fair representation of consumer feedback.
- Buying Positive or Negative Reviews
- Paying for positive reviews to boost your reputation or negative reviews to harm a competitor is strictly prohibited.
- Review Hijacking
- You can no longer repurpose a consumer review meant for one product, then just reword it and use it for another product or service that is substantially different.
- Misrepresenting the Reviewer
- Businesses must not misrepresent the identity, experience, or views of the reviewer. Authenticity matters.
The FTC is serious about cracking down on these deceptive practices. If your business is found in violation, you could face significant penalties. The new FTC rule follows an extensive process, including a Notice of Proposed Rulemaking (NPRM) published in the Federal Register on July 31, 2023, and informal hearings held on February 13 and March 6, 2024.
